But before we close, I wanted to get to a favorite question of mine: Since you have to pay for this stuff anyway, is there potential for creating greater value than simply "discovery?" Can a wise businessperson make extra value points by smartly deploying the right tools?

"Whether or not they are on either side of that fence depends on their strategic, long-term view," says Steve d’Alencon. "The smart ones are looking at e-discovery not just as an umbrella for litigation readiness, but as an umbrella for a number of related requirements, including governance, risk and compliance; information security; privacy; internal investigation; merger and acquisition... Understanding ESI is at the heart of all those functions."

"It’s something I call ‘five-to-one economics,’" adds Matt Camassa. "ESI encompasses five different areas: internal usage policy and enforcement; knowledge management; business continuity; e-discovery; and storage and data management. If someone spends the money to store and search for data for one of those purposes, they should ask, ‘what else can I do with it?’ It’s more than just e-discovery at stake here; having different people help make these decisions will certainly affect the type of solution you put into place."
