Investigate Or Investigated?
The Credit Crisis is Turbo-Charging Enterprise Search
As stated throughout this article, a problem with this type of approach is that most internal (Web-type) search engines are not 100% suited for legal search actions and won’t provide adequately thorough and consistent results. As a result, when a court reviews the respective discovery process, for example, the court may not find the disclosed data’s level of completeness to be acceptable. A new search, then, would have to be implemented, which would inevitably come at a high cost and even stricter deadlines, increasing the overall risk.
A newer, more acceptable approach is to create an XML-based parallel archive for the proprietary-repository data in a cheap storage solution (often a NAS or a multi-terabyte external hard disk, which often cost less than $500). The external storage is then fully searchable with the most advanced legal search tools. Data that is initially not searchable—such as ZIPs, bitmaps or multimedia—can then be made searchable, and legal departments can search whatever they want, whenever they want, without any restriction. Although the redundant storage may sound a bit awkward, this approach is often the most pragmatic and in the long term proves to be the most cost-effective solution for such proprietary archives.
Of course, the final answer to help solve all discovery-based problems rapidly seeping through the financial sector is to have a proper records management framework in place, with a true enterprise search mechanism to drive it.
